The Supreme Court has taken up a significant case involving the rights of disabled individuals who wish to enter the judicial services in Uttarakhand. On Friday, the apex court sought responses from the state government and its public service commission after receiving a petition challenging the exclusion of candidates with blindness and locomotor disabilities from the judicial service examinations.
Justices J B Pardiwala and R Mahadevan noted Sravya Sindhuri’s petition, which contests alleged discriminatory recruitment practices. The plea argues that such exclusions violate constitutional rights and contravene the Rights of Persons with Disabilities (RPwD) Act of 2016, which guarantees equal opportunity.
The court referred to a landmark decision in March that struck down similar provisions in Madhya Pradesh, reinforcing the fundamental right against discrimination. The petition also questions an advertisement issued on May 16, seeking its cancellation for imposing unlawful restrictions and a domicile condition that excludes non-resident disabled candidates.
