Apple has filed a federal lawsuit against Apple Cinemas, a U.S. movie theater chain, in Massachusetts for alleged trademark infringement and customer confusion. According to the lawsuit, Apple Cinemas is using the name “Apple” to benefit from its global recognition and reputation, which the company has built over decades. This isn’t just about the word “Apple”; it’s also about protecting some of the world’s most valuable brands.
Apple is taking legal action to stop Apple Cinemas from using its name during nationwide expansion
Apple Cinemas was founded in 2013 and initially operated primarily in the Northeastern United States. However, it recently opened a West Coast location in San Francisco and announced plans to expand aggressively to 100 theaters across the nation. Notably, some of these locations are in important metropolitan areas and near Apple’s retail stores, including its home turf in Silicon Valley.
Apple’s lawsuit, which can be read here, claims that the expansion increases the likelihood of consumers assuming a partnership or affiliation between the two companies, something Apple believes is entirely false. The company had previously warned Apple Cinemas and in October 2024, the USPTO denied applications for both “Apple Cinemas” and “ACX – Apple Cinematic Experience.” Additionally, Apple sent cease-and-desist letters urging the theater to stop using the name.
In its filing, Apple states that “Apple Cinemas is knowingly and intentionally using the name Apple to sow confusion for its own benefit.” The lawsuit seeks an injunction to prevent further confusion, monetary damages, and possibly a court-ordered rebranding. Despite acknowledging that the movie theater industry differs from its technology business, Apple argues that brand dilution and misinterpretation are risks it cannot ignore.
Apple only wants to safeguard its identity, while Apple Cinemas aims to grow its business through expansion. However, it remains to be seen which side the court ruling will favor. This case could also set an important precedent for future trademark disputes between unrelated industries.
