Gupta initially agreed to a confidential settlement with Intel but was caught using internal knowledge to negotiate with Intel while working for Microsoft in 2021. Following this, he pleaded guilty in February and faced additional charges of possessing stolen trade secrets in December 2024. The prosecution argued for an eight-month prison sentence, emphasizing Gupta’s repeated use of internal documents.

However, Gupta’s defense highlighted that he had already paid a $40,000 settlement and suffered reputational damage, which ended his career in the technology industry. His attorney also pointed out that Gupta neither enriched himself nor transferred sensitive trade secrets to foreign entities. Judge Amy Baggio ultimately agreed with this recommendation and sentenced Gupta to eight months’ probation, adding a $34,472 fine as a deterrent.

Gupta has now shifted his family to France and plans to work in the wine industry. He is undertaking graduate studies in vineyard management and hopes to rebuild his career in the French winemaking sector. The judge considered Gupta’s loss of reputation as one reason for the lenient sentence.
