In his ruling, Judge Breyer noted that Congress, through the 1878 Posse Comitatus Act, prohibited using the U.S. military for domestic law enforcement. However, he found no evidence of a rebellion when Trump deployed National Guard troops and Marines to Los Angeles in June to quell protests against immigration enforcement.
Breyer cited plans to expand the guard deployment to Oakland and San Francisco and other states across the country. He wrote that there was no rebellion, and civilian law enforcement could handle the situation. Instead, he found that soldiers, often wearing protective armor, were used to set up perimeters, engage in crowd control, and demonstrate a military presence around Los Angeles.
Currently, 300 National Guard members remain stationed there.
